SC DISMISSES PLEA AGAINST RBSE 10th BOARD EXAMS

The news got spread to a long way when the Supreme Court rejected the plea. Which was filed against the decision directed by the State High Court? The SC dismissed the plea of not conducting RBSE 10th board exams. As decided to happen from 29th of June directed by the State High Court previous month.

A three-judge bench led by justice AM Khanwilkar dismissed the plea filed. The SC stated the order under challenge was passed by the State high court a month ago i.e. on May 29th. Since then there has been no significant rise in the COVID-19 patients near or around the examination centres as described by the board.

THE PLEA AGAINST EXAMS

The plea was filed by a parent of a class Xth student who has appeared for the four exams that were conducted before the lockdown. For the remaining two exams, they told the court, that the decision to conduct remaining exams is not necessary. They also stated that this a violation of their basic constitutional right stated under Article 14.

The plea stated that “ Almost 100-120 schools which are designated examination centres for the state were used as quarantine centres. Used for helping the migrant labourers during the lockdown for treatment and necessities. Thus conducting exams at such centres is not correct and somewhat discriminatory as it may lead to edging the health and safety of the students and their families. Hence it is regarded as a clear violation of Articles 21 and 14 of the Indian Constitution.”

PARENTS CONCERN

The parents also brought up the fact, that the Supreme Court also accepted the decision for not conducting the exams for the students of CBSE and ISCE boards earlier this week. Because the cause of the decision is similar which is the exponential increase in COVID-19 patients in the present times.

The petition also stated that “ The High Court has failed to appreciate about potential solutions to be provided by RBSE board. The RBSE has not provided any solution to basic problems regarding the movement of students. Especially those coming from any containment zones as identified by the State health department. Also, the plea against RBSE undertakes the improper guidelines provided by the board to the parents. Most importantly, about the pre-procedure for safe conduction of exams.”

DECISION IS TAKEN: RBSE WILL CONDUCT 10th EXAMS

Although the Rajasthan state Board, RBSE clearly states that the exams will be conducted on 29th and 30th of June, 2020. Under which 11,86,418 students of class Xth will be appearing for the completion of the remaining two exams. The SC respected the decision taken by the RBSE for conduction of the examination. Directing to follow the guidelines as provided by the State High Court earlier.

The SC puts their faith in the graces of the RBSE state board. And it believes that enough precautionary steps have been duly taken. But parents will do remain stressed for these two days and students a bit scared and confused too.
